How fees are set

Statutory battery levies (opłata produktowa and education campaign fee) — Statutory levies under the Act of 24 April 2009 on batteries and accumulators; collected by the marshal's office of the voivodeship.

Poland runs two statutory battery levies and they work in opposite ways. The opłata produktowa is a fallback price for missing the collection target: it is charged only on the difference between the mass of spent portable batteries that had to be collected and the mass actually collected, so a producer that hits the target pays nothing at all. The act fixes a statutory range of 0.80 to 12 złoty per kilogram and a 2009 ministerial regulation, still in force, sets the rate inside that range at 9 złoty per kilogram. The public education campaign fee is the opposite: a flat 0.03 złoty per kilogram on everything placed on the market, reducible by what the producer actually spends on campaigns itself and waived entirely below 10 złoty a year. A third instrument, the opłata depozytowa, is a 30 złoty deposit per lead-acid automotive battery refunded on hand-back; it is a deposit rather than an EPR rate and is recorded in the row notes only.

Public education campaign fee — batteries and accumulators Code GEN-UNS-EDUCATION 0.03 PLN/kg The Polish act does not assign the five categories of Regulation (EU) 2023/1542 to this levy: it is charged on all batteries and accumulators placed on the market. Unconditional, unlike the opłata produktowa: the fee is the rate multiplied by the mass placed on the market in the calendar year (Art. 37(5a) and (5b)). A producer whose obligation does not exceed 10 zł in a calendar year does not have to finance the campaigns (Art. 37(8)). The product fee is charged only on the shortfall against the statutory collection target, not on everything placed on the market, so it is not comparable with a per-kilogram scheme fee. The 800 PLN/Mg figure circulating in secondary sources is the statutory lower bound of the rate band, not a rate.
