How fees are set

Statutory WEEE product fee (opłata produktowa) — Statutory levy under the Act of 11 September 2015 on waste electrical and electronic equipment; rates set by ministerial regulation under art. 74(2); collected by the marshal's office of the voivodeship.

Poland's WEEE product fee is a fallback price for missing a target, not a tariff on everything placed on the market: it is charged on the difference between the required and the achieved level, computed group by group, so a producer that hits its targets pays nothing. Reading it correctly requires two levels of law. The act itself fixes only a range - 4 to 8 złoty per kilogram for lamps and 0 to 2 for every other group - and delegates the actual figures to a ministerial regulation; the regulation of 14 June 2018 sets them at 7.50 złoty per kilogram for lamps and 1.80 for the other five groups. The act's Annex 1 uses the six Directive categories verbatim, so the group numbers are the Directive numbers. Two further amounts are not rate lines: an additional fee of 50 per cent of any unpaid amount, and the public education campaign obligation of 0.1 per cent of net revenue, which has no per-kilogram form. Nothing is payable where a group's fee does not exceed 50 złoty.

ᴮ bonus / discount · ᴹ malus / surcharge. The statute gives lamps their own higher rate band (4–8 PLN/kg under art. 74 ust. 1) and leaves the other five equipment groups to share the lower one, which is the clearest statement anywhere in this channel of why lamps cost more. The 1000 PLN/Mg figure that circulates in secondary sources has no counterpart anywhere in the statutory chain.
